1. All sales conducted during the Auction are conducted under published Auction Rules, Policies and Procedures. Purchaser acknowledges that he/she is responsible for obtaining a copy of the applicable auction Rules, Policies and Procedures and Purchaser therefore agrees to be bound by same, as H Greg Auto Auction has the right to amend as necessary without warning to purchaser;

2. Purchaser must present a valid drivers license at all times prior to purchase;

3. The winning Purchaser must pay a deposit in the amount of $300.00 payable in either Cash, Credit Card, Bank Check or Money Order;

4. Purchaser’s information will be used to prepare all Title work for the vehicle purchased. Once the title work has been completed there is a $100.00 fee to have it changed;

5. All vehicles are sold "AS IS" with all defects unless stipulated otherwise on the Buyer’s guide or are auctioned as “Green Light”. All sales are final.

6. All vehicles must be paid in full by noon the next business day, failure to do so will result in a $100.00 additional fee per day. Any vehicle not paid for in full by the next business day will be considered forfeited and all deposit money paid by the Purchaser shall also be forfeited. If Purchaser fails to pay H Greg Auto Auction for a vehicle purchased, H Greg Auto Auction will be allowed to sell the vehicle to mitigate their losses without any further notice to the Purchaser and Purchaser will be fully liable to H Greg Auto Auction for any and all loses from the resale of the vehicle including but not limited to incidental and consequential damages. Notice of resale required by any other law is waived;

7. Vehicles not removed from the auction premises by 5 pm on the next business day will result in an additional fee of $100.00 per day. H Greg Auto Auction will not be responsible for any vehicles left on the premises;

8. The present Agreement constitutes a full and mutual understanding of the parties’ rights and obligations and supersedes any and all prior negotiations, representations, or agreements, either written or oral, with respect to the Auction. Each signatory Purchaser to this Agreement shall be jointly and severally liable under this Agreement. If any provision hereof or the application of any provision to any persons or circumstances are held invalid or unenforceable by a Court of competent jurisdiction, said provision shall be deemed deleted and the remainder of the Agreement shall remain in full force and effect;

9. The applicable laws to govern the present Agreement shall be construed under the laws of the State of Florida. Jurisdiction and venue shall be in Miami Dade County, Florida. The parties hereto further agree that in the event suit shall be brought for the collection hereof, or the same has to be collected upon demand of an attorney, the Purchaser shall pay all attorney's fees and costs for making such collection;

10. The parties hereto mutually, knowingly and voluntarily waive the right to a trial by jury, and neither Party shall seek a trial by jury. In any lawsuit or proceeding including but not limiting any counterclaims based upon or arising from or related to this Agreement. The waiver contained herein is irrevocable and shall be subject to no exceptions;

11. The Purchaser hereby acknowledges having read and understood the meaning of this Agreement by executing the present Agreement.

12. In the event you would like the title written in someone else’s name, they must be present and they must present their valid drivers license.
